TERMS OF SERVICE AND LICENCE
Australian Workplace – Defensible Decisions™ (D2) Framework
1. Overview
These Terms of Service govern access to and use of products and services provided by Australian Workplace, including the Defensible Decisions™ (D2) Framework.
By purchasing or using any product or service, you agree to be bound by these Terms.
2. Intellectual Property
All materials associated with the Defensible Decisions™ (D2) Framework, including but not limited to:
- structure
- methodology
- models
- frameworks
- workbooks
- templates
- written content
are the intellectual property of Australian Workplace.
These materials are protected under the Copyright Act 1968.
3. Trademark
“Defensible Decisions™” and “D2 Framework” are trademarks of Australian Workplace.
You must not:
- use these names commercially
- reproduce branding
- present the framework as your own
without prior written consent.
4. Licence Grant
Upon purchase, you are granted a:
non-exclusive, non-transferable, revocable, single-user licence
to use the D2 Framework for your own professional purposes.
5. Permitted Use
You may:
- apply the framework in your professional role
- use the methodology to support workplace decision-making
- generate outputs using the framework
6. Prohibited Use
You must not:
- copy, reproduce or distribute the framework
- share files with other individuals or organisations
- upload materials to shared drives or public platforms
- resell, sublicense or commercialise the framework
- modify and distribute the framework as your own
7. Organisational Use
Where multiple individuals within an organisation require access:
separate licences must be obtained.
Use by multiple users under a single purchase is not permitted.
8. Digital Products
All digital products are delivered electronically.
Upon purchase:
- access is granted via download
- responsibility for file security transfers to the purchaser
Australian Workplace is not responsible for:
- unauthorised sharing after download
- loss of files after delivery
9. Refund Policy
Due to the digital nature of the products:
all sales are final and non-refundable
except where required under applicable Australian Consumer Law.
10. No Legal Advice
The D2 Framework is designed to support structured decision-making.
It does not constitute legal advice.
Users must apply:
- applicable legislation
- organisational policies
- professional judgment
11. Limitation of Liability
To the maximum extent permitted by law, Australian Workplace is not liable for:
- decisions made using the framework
- outcomes of workplace matters
- any direct or indirect loss arising from use
12. Indemnity
You agree to indemnify Australian Workplace against any claims, losses or liabilities arising from:
- misuse of the framework
- breach of these Terms
- reliance on the framework without appropriate professional judgment
13. Governing Law
These Terms are governed by the laws of: New South Wales, Australia
14. Amendments
Australian Workplace may update these Terms at any time.
Updated Terms will apply from the date of publication.
