Defensible Decisions™ (D2) Framework - Professional Advisory
Defensible Decisions™ (D2) Framework – Professional Advisory
This service applies the Defensible Decisions™ (D2) Framework to a live workplace matter where the decision outcome carries risk.
It is designed for situations where the decision must withstand external scrutiny — including review by employees, representatives, regulators, or the Fair Work Commission.
Purpose
This advisory addresses the point at which most workplace failures occur:
The transition from:
- evidence
- to findings
- to outcome
- to justification
The focus is not on process.
The focus is whether the decision position can be justified.
When This Service Is Required
Engagement is appropriate where:
- the evidence base is contested, incomplete, or inconsistent
- findings do not clearly support the proposed outcome
- the outcome carries legal or reputational consequence
- the reasoning cannot be clearly articulated or documented
- the matter may proceed to external review
If the decision cannot be explained in structured, evidence-based terms, it is not defensible.
Scope of Review
The matter is assessed against the D2 Framework, including:
Evidence Position
- relevance, reliability, and corroboration
- gaps, contradictions, and sole-basis risk
Findings Formation
- whether findings are logically derived from evidence
- whether alternative interpretations have been excluded
Conduct Classification
- alignment between established conduct and classification applied
Outcome Selection
- proportionality of outcome to conduct
- consistency with established decision standards
Decision Reasoning
- whether the justification is complete, structured, and defensible
- whether procedural fairness considerations are addressed
Assessment Output
The advisory provides:
- identification of reasoning gaps and structural weaknesses
- assessment of defensibility in its current form
- required corrections to reach a defensible position
- clarification of where the decision is exposed to challenge
This is not general feedback.
It is a decision integrity assessment.
Role Clarity
This service does not:
- make the decision
- replace the decision-maker
- provide legal advice
The decision remains yours.
This service ensures that the decision position is capable of being justified.
Outcome
Following advisory, the decision should:
- align with the evidence base
- demonstrate logical consistency
- reflect proportionate outcome selection
- be capable of explanation under scrutiny
If it cannot meet that standard, it should not proceed in its current form.
Engagement Process
- Matter documentation is provided
- Structured review is conducted using the D2 Framework
- Assessment and required adjustments are identified
- Decision position is refined prior to finalisation
Delivery

Final Position
This service is used where the risk is not uncertainty in the facts —
but exposure in the decision.
A decision that cannot be explained is a decision that will not withstand review.
